Pro Bono Traffic Court Clinic

There is never any charge for motorists represented by the Pro Bono Traffic Court Clinic

Students certified under the Practical Training of Law Students California State Bar program and under the supervision of a licensed attorney represent individuals with infraction prosecutions (Traffic Tickets, including speed, cellphonex/texting and sign violations, municipal code violations including Trolley and Loitering). Case must be pending before the Kearny Mesa branch of the San Diego Superior Court.

Students undergo an extensive 5 week, 49 hour training on the law, procedures, defenses, motion practice and trial practice. They are required to pass examinations, obtain a certification and satisfactorily complete and submit mock trial and motion before being permitted to participate in the clinical portion of the training.

In the clinical training, students will counsel infraction litigants, negotiate on their behalf, prepare their case for trial, represent in court proceedings including trial.

Attorney volunteers to help handle trial call or select pending motion or appellate litigation would also help expand access to services and justice for the populations sought to be served.

Interpreters will help our students and lawyers reach economically disadvantaged immigrant populations to inform them of their rights and responsibilities under the law.

  • Training / Supervision Comments: Students: must be attending California Western School of Law. Attorneys: to help cover trial calendar and provide additional supervision of law students. Training, supervision and mentoring of attorneys will be provided as needed. Interpreters: Can use any language interpretation or translation assistance provided there is a corresponding immigrant population here in San Diego. With AB60 approaching, immigrants will have questions about the consequences of traffic matters and whether to obtain a California license. The more immigrant populations the Clinic is able to reach through interpretive services, the better, as these tend also to be economically disadvantaged populations.
